Overview

Eran Bezalel is one of the firm’s Co-Managing Partners. Eran’s practice spans a wide range of complex commercial disputes, including all aspects of administrative law commercial real estate, contractual, corporate and competition law. He has appeared before the entire range of Israeli courts and arbitration tribunals and has considerable experience in multi-party litigation, class actions and contentious competition law related issues.

Eran has particular expertise in the field of complex tenders and government procurement projects, advising on major, multi-million dollar public and private tenders of every description. His clients include bidders (including special purpose bid vehicles formed by local and global project partners) as well as government authorities and government companies. He has extensive experience advising clients on procurement strategies, providing clients ongoing counsel throughout the complex tender process, including aspects of financing, project management and, where necessary, representing clients when tender-related disputes arise.

Eran has advised on a large number of groundbreaking BOT, PFI and PPP national infrastructure and construction projects in Israel, including: the high-speed railway tunnel to Jerusalem; the Fast Lane project on Highway 1; the extension to the Cross-Israel Highway, the first and longest toll road in Israel; and the new military schools and barracks for the Israel Defence Forces in Southern Israel. His government procurement practice also includes advising on tenders for the purchase of services and equipment from diverse sectors, including the pharmaceutical, technological, financial, infrastructure and construction sectors.

The Marker, Israel’s leading financial online and print magazine, included Eran in 2014 in their shortlist of the “40 Most Promising People Under the Age of 40”.

In 2020, Eran was singled out by The Legal 500 as a leading partner ( “very professional and brilliant litigator”), in the field of dispute resolution: local litigation and arbitration.

In addition,  Eran regularly lectures on behalf of the Israel Bar Association on issues related to administrative law and tenders before various universities, companies and organisations that wish to train or educate their employees in these fields.

Experience

  • Representing IDE in an administrative petition it submitted opposing a petition submitted by 4A Desalination Ltd., both relating to a tender published by the ministries of energy and finance together with the Water Authority for the “Finance, Design, Construction, Operation, Maintenance and Transfer of a Sea-water Desalination Facility” for a period of 25 years (known as “Sorek B”). This is the largest and most complex project of its kind in the world, designed to provide 20% of the drinking water consumed in Israel and valued at NIS 5-6 billion.
  • Representing Derech Eretz Highways (1997) Ltd., the concessionaire of Highway No. 6 (Cross-Israel Highway), in various complex disputes with Derech Eretz Highways Management Corporation Ltd., estimated in hundreds of millions of NIS, including arbitration proceedings regarding the yearly operation fee.
  • Representing Shapir Civil and Marine Engineering Ltd., Israel’s largest construction, development and civil engineering company, in its capacity as concessionaire of the northern extension of the Cross- Israel Highway. This includes acting on all matters under the concession agreement relating to Shapir’s concession to build, operate and transfer this significant portion of the Cross-Israel Highway, in addition to representation with respect to all disputes and monetary claims arising between the implementing authority regarding execution of the northern extension of the Cross-Israel Highway. Thus far, eight claims have been submitted to the arbitrators, in the total sum of approximately NIS 400 million. All disputes between the parties amount to approximately NIS 1.2 billion.
  • Representing Shapir Civil and Marine Engineering Ltd. in proceedings before the Supreme Court concerning a complex tender valued at NIS 6 billion for the DBOT project for the Cross-Israel Highway.
  • Representing Shapir Civil and Marine Engineering Ltd. in an NIS 170 million lawsuit against the Government regarding construction of a BOT project for a fast lane on Highway 1 between Ben Gurion Airport and Tel Aviv. Representing Changchun Railway Vehicles Ltd. in legal proceedings after it was awarded the tender for the planning, manufacture, supply and maintenance of carriages for the Tel Aviv Light Rail. This tender is valued in excess of NIS 1 billion.
  • Representing Changchun Railway Vehicles Ltd. in hearing proceedings before the Industrial Cooperation Authority, regarding the compliance of CRRC with all of its obligations (realization of the implementation plan and carrying out industrial cooperation), both pursuant to law and the agreement signed following award the tender.
  • Representing Phoenix Insurance Company Ltd. in a number of insurance tenders, in particular tenders for insurance of local authorities.
  • Representing Schulz Yechiel Holdings Ltd. and the Schulz family in a complex dispute regarding an agreement to sell 80% of the stocks of Schulz Catering Quality Company 1997 Ltd. to Swan Holdco Emi Ltd., owned by the Apex Fund.
  • Representing Teva Pharmaceuticals Ltd., the world’s largest generic drug manufacturer, against an administrative appeal filed by a baby food manufacturer in connection with a high value tender issued by the Ministry of Health for the supply of baby food to government hospitals, which was awarded to Teva.
  • Representing Interest Rates Ltd. in a series of administrative appeals and petitions to the Supreme Court regarding a complex tender published by the Ministry of Finance for the operation of a financial system for the calculation of the value of illiquid assets, valued in the billions of NIS, for Israeli institutions.
  • Representing the Israel Electric Corporation in precedent-setting proceedings concerning an international public tender for the purchase of copper cabling.
  • Representing the Paz Group, Israel’s leading energy corporation, in several multi-million dollar commercial and antitrust disputes, including a long-running dispute with petrol and gas station operators.
  • Representing Paz before the Supreme Court in proceedings filed by Paz against the ministers of finance and energy, as well as other public entities, challenging and seeking to set aside the Government’s decision to reduce the profit margins of fuel companies on the sale of certain fuel products falling under the price control regime.

Since 2012, Eran has been Chairman of the Administrative Affairs and Tenders Committee of the Tel Aviv District of the Israel Bar Association.
