Orit is a commercial litigator with extensive experience in all aspects of dispute resolution. Her practice focuses on complex high-value disputes in the real estate, construction and energy sectors, as well as disputes with local authorities concerning municipal taxation, and contractual disputes.

Orit’s practice includes acting on disputes regarding rights in connection with land ownership, use and leasing, often representing clients in complex claims against the Israel Land Administration – claims that require a forensic review of historic records which pre-date the founding of the State.

Her expertise includes defending, challenging or seeking to set aside regulatory, ministerial and governmental decisions, before the full range of Israel’s administrative courts and tribunals.

Orit’s clients include local and global companies, energy companies, construction companies, real estate owners and agricultural collectives (moshavim), as well as public bodies and local authorities.

Experience

Orit’s extensive experience includes:

  • Representing the Tel Aviv Municipality in one of the largest disputes in the history of Israel, concerning claims by the Tel Aviv and other municipalities in Israel against the Israel Land Administration, for monies due to the municipalities. The claim was successful, and it was valued at approximately USD 560 million.
  • Representing the Jewish Agency, in claims concerning its rights in agricultural collectives (moshavim) set up prior to the establishment of the State.
  • Representing Paz Ltd. (Israel’s largest oil company) in several multi-million dollar commercial and antitrust disputes, including a long-running dispute between Paz and its petrol station operators.
  • Representing Cim Lustigman Ltd. (an Israeli subsidiary of Metrontario Group, a multi-faceted investment and construction organization operating primarily in Canada and the US) in several claims valued at dozens of USD against the former entrepreneurs of a real estate development project in Jerusalem’s French Hill neighborhood. In addition, defending Lustigman against a USD 30 million claim filed against it by the Custodia Terrae Sanctae, among others.
  • Representing Baron Benjamin Hotels Ltd. in mutual claims between it and Fattal Hotels Ltd., a multinational hotel corporation with more than 197 hotels in Israel and Europe, regarding the enforcement/cancelation of a management agreement for the Leonardo Hotel in Ashkelon.
  • Representing Kishon Drainage & Rivers Authority (“KDRA”), which carried out the flagship project of Israel’s Ministry of Environmental Protection– the “Kishon River Sediment Dredging & Remediation Project”. The case involved a complex and highly sensitive commercial and legal dispute with the foreign contractor hired by Kishon to execute the project, regarding mutual claims of damages exceeding NIS 200 million.
  • Hanotea Ltd. against the Israel Land Administration, in a claim to gain recognition of rights over 114 dunams of land adjacent to the city of Netanya’s coastal plain.
  • Representing Yakhin Hakal Ltd. (one of Israel’s longest-standing businesses, as well as one of its largest agricultural companies) and the estate of the late Sami Shamoon, in an appeal Israel’s Supreme Court against the Israel Land Administration, seeking to enforce a governmental commitment (made by the former Prime Minister of Israel, the late Mr. Ariel Sharon)– to extend Yakhin’s lease agreements relating to tens of thousands of acres of land across the state, for an additional period, under the same conditions.
  • Representing Ben Ari Ltd. (one of Israel’s most prominent infrastructure companies), in a claim for recognition of rights in a quarry, and in proceedings against the Israel Land Administration for the allocation of land in a national priority area for the establishment of a concrete and asphalt factory.
  • Representing the Israel Electric Corporation in proceedings in which the high court rejected claims by a number of municipalities against the Corporation for taxes amounting to hundreds of millions of NIS, in respect of electricity lines running through their districts.
  • Representing the Israel Electric Corporation in a large number of proceedings against local authorities concerning claims by the authorities for payment of municipal taxation.
  • Representing Granite Hacarmel (one of Israel’s major infrastructure companies and a subsidiary of the Azrieli Group, Israel’s largest real estate company) in proceedings against the Water Desalination Administration, concerning the client’s licence for operation of a desalination plant, following a sharp reduction in the quantity of water for desalination granted via the licence. As a result of the proceedings, the reduction was minimized significantly.
  • Representing the board of directors of the Hamashbir Lazarchan department store chain in a series of claims instituted against members of the board following the chain’s insolvency.
