Hagar is a partner in the firm’s Dispute Resolution Practice Group. Her practice spans a wide range of complex commercial disputes, including all aspects of administrative, commercial, contractual, corporate and competition law.

Hagar has extensive experience representing the firm’s clients on a broad range of civil and contractual matters before the entire range of Israeli courts and tribunals. Her practice focuses on high-value issues involving complex commercial disputes, complex construction and infrastructure disputes, energy sector disputes, tender related disputes and administrative law.

Hagar advises international and domestic companies from a wide range of sectors, including energy, civil engineering, infrastructure, and pharmaceuticals. Hagar’s clients include a wide range of construction and infrastructure companies as well as insurance companies. Her practice includes advising clients on participation in multi-million dollar tenders, in particular: defending their right to participate in a tender; commencing proceedings to disqualify non-compliant competitive bidders; challenging, or defending, the actions or procedures of the body issuing or awarding a tender; and challenging the tender process in the administrative affairs court. Hagar has extensive experience acting for clients on commercial disputes, as well as construction disputes related to the design, construction, operation and functional performance of major infrastructure projects.

Hagar joined S. Horowitz & Co. in 2010, where she completed her internship and qualified as an Israeli advocate.

Experience

  • Representing IDE in an administrative petition it submitted and opposing a petition submitted by 4A Desalination Ltd., both relating to a tender published by the ministries of energy and finance together with the Water Authority for the “Finance, Design, Construction, Operation, Maintenance and Transfer of a Sea-water Desalination Facility” for a period of 25 years (known as “Sorek B”). This is the largest and most complex project of its kind in the world valued at NIS 5-6 billion.
  • Representing Derech Eretz Highways (1997) Ltd., the concessionaire of Highway No. 6 (Cross-Israel Highway), the first and longest toll road in Israel, in connection with various complex disputes that have arisen with the operator of Highway 6.
  • Representing 6 Cross-Israel North Ltd. (“Cross-Israel North”), inter alia, regarding implementation of the concession agreement as well as the construction, development and operation of Highway 6 (northern route), the central toll road in Israel. In addition, representing Cross-Israel North in all legal disputes and claims raised and/or filed by it against the implementing authority on behalf of the State, Cross-Israel Highway Ltd. As to May 2020, Cross-Israel North has filed claims by engaging in arbitration as set out in the concession agreement, amounting to NIS 400 million.  All such disputes between the parties are estimated at NIS 1.2 billion.
  • Representing Super NG Natural Gas Distribution Ltd. in several matters relating to the energy sector, including legal opinions with respect to gas distribution licensing.
  • Representing Super NG in a petition submitted to the Israeli High Court of Justice against the Minister of National Infrastructure, Energy and Water Resources and the Director of the Natural Gas Authority and Super NG. After a lengthy hearing, the petition was rejected by the Court.
  • Representing Changchun Railway Vehicles Ltd. in legal proceedings after it was awarded the tender for the planning, manufacture, supply and maintenance of carriages for the Tel Aviv Light Rail. This tender is valued in excess of NIS 1 billion.
  • Representing Phoenix Insurance Company Ltd. in several insurance tenders, in particular tenders for insurance of local authorities.
  • Representing Schulz Yechiel Holdings Ltd. and the Schulz family in a complex dispute regarding an agreement to sell 80% of the stocks of Schulz Catering Quality Company 1997 Ltd. to Swan Holdco Emi Ltd., owned by the Apex Fund.
  • Representing Shapir Civil and Marine Engineering Ltd., Israel’s largest construction, development and civil engineering company, in Supreme Court proceedings concerning a complex tender valued at NIS 6 billion for the DBOT project for the Cross-Israel Highway.
  • Representing Teva Pharmaceuticals, the world’s largest generic drug manufacturer, against an administrative appeal filed by a baby food manufacturer in connection with a high value tender awarded to Teva by the Ministry of Health for the supply of baby food to government hospitals.
  • Representing Interest Rates Ltd. in a series of administrative appeals and petitions to the Supreme Court regarding a complex tender published by the Ministry of Finance for the operation of a financial system for the calculation of the value of illiquid assets for Israeli institutions, valued in the billions of NIS.
  • Representing the Paz Group, Israel’s leading Energy Corporation, in several matters relating to disputes with petrol and gas station operators.

Other Activities

While a student at Bar Ilan University, Hagar volunteered at the University’s Mediation Clinic, where she provided pro bono mediation training and services to a wide range of clients, including schools, individuals, and non-profit organizations.

 

Hagar also served as a teaching assistant at the Ono Academic College in a unique program that focuses on daily practice of the legal profession.
