Israel Aviation Law 2026: Post-War Recovery, New Cargo Rights and Key Passenger Rulings

1 min. read

After the disruption of the war, Israel’s aviation sector spent 2025–2026 rebuilding. Ben Gurion Airport handled about 18.4 million passengers in 2025, close to 95% of pre-war 2022 levels, and around 60 foreign airlines now operate there. The legal landscape has shifted too: a new US–Israel protocol grants seventh-freedom rights to cargo carriers, the Supreme Court has ruled that airlines must actively offer passengers of cancelled flights a choice between a refund and an alternative flight, and the Tel Aviv District Court has clarified that EU261 claims require proof of foreign law. Our Israel chapter of Lexology In-Depth: Aviation Law covers these developments and more.
