Overview

Ohad Ben-Yehuda is a commercial litigator whose practice mainly focuses on large-scale disputes, including all aspects of commercial law, and who has appeared before the entire range of Israeli courts and arbitration tribunals.

Ohad has particular expertise in the field of complex disputes in the energy, construction and infrastructure sectors.  He has acted on a wide array of matters affecting the Israeli energy sector as well as disputes arising in major infrastructure projects valued at hundreds of millions of US dollars, relating to the design and construction of ports, highways, interchanges, tunnels and public buildings.

His clients include the largest oil and energy companies in Israel, as well as a broad range of domestic and international infrastructure companies.

Ohad also advises clients on dispute avoidance, managing and resolving claims and disputes by way of negotiation, mediation or expert determination.  He also provides ongoing legal advice to infrastructure companies at all stages of a project, including the tender proposal submission stage and the later execution stages.

Ohad’s expertise also includes defending, challenging and seeking to set aside regulatory, ministerial and governmental decisions, in legal proceedings before the High Court of Justice and the Court for Administrative Affairs.

Experience

Ohad’s extensive experience includes representation of:

  • The Paz Group in several multi-million dollar commercial and antitrust disputes, including a long-running dispute between Paz and its petrol station operators
  • The Oron Holdings & Investments Group, providing ongoing legal advice regarding projects for the construction of, inter alia, several highways, bridges and tunnels valued at hundreds of millions of shekels
  • The Oron Holdings & Investments Group in a number of high-value proceedings in connection with tenders in which the group’s companies participated
  • The Paz Group before Israel’s Supreme Court in proceedings filed by Paz against the Finance Minister, the Minister of Energy, and other public entities challanging and seeking to set aside the Government’s decision to reduce the profit margins of fuel companies on the sale of certain fuel products that fall under the controlled prices regime
  • The Paz Group in hearing proceedings before the Competition Authority, in connection with Antitrust issues
  • The Paz Group in a number of proceedings for the removal of franchisees from petrol stations owned by the group
  • Ashtrom Group, one of Israel’s largest construction companies, and its European joint venture partner, Dragados, in a NIS 1 billion (US$ 285 million) claim against the Ashdod Ports Authority for additional compensation arising from the Ports Authority’s mismanagement of the HaYovel port in Ashdod. We acted for the clients in a successful settlement of the claim through mediation
  • Shapir Civil and Marine Engineering and a foreign infrastructure company in connection with the performance of infrastructure works at the Ashdod Port valued in the millions of dollars
